Thermal Imaging Camera Loan Scheme – Terms and Conditions of Use
This thermal imaging camera is provided exclusively for use by GAPTC member councils as part of our Climate Action Toolkit. By borrowing the camera, the council agrees to the following terms and conditions:
1. Loan Period and Return
- The standard loan period is two weeks , unless otherwise agreed in writing by GAPTC.
- The camera must be collected and returned at the agreed time and location. If this becomes impossible, alternative arrangements must be made with GAPTC as soon as possible.
- Late returns may result in loss of access to the loan scheme or affect future bookings.
2. Condition Check and Equipment Care
- The camera will be inspected by GAPTC before the loan and its condition recorded. The borrower must check the camera and accessories on collection and report any existing damage immediately.
- The camera and all accessories (including case, charger, cables, and instruction manual) must be returned in the same condition.
- The camera must be kept secure at all times, either in the borrower’s possession or in a locked location when not in use.
- The camera must not be loaned or given to any third party or used by non-council individuals or organisations.
3. Insurance and Loss
- The camera is insured against accidental damage and loss provided these terms are followed .
- Negligence or failure to comply with these conditions may invalidate insurance cover. The borrower may then be liable for the full cost of repair or replacement, either personally or through their council’s insurance.
- In the event of loss or theft, the borrower must notify GAPTC immediately and report the incident to the police within 24 hours to activate insurance cover.
4. Prohibited Use
The camera is provided solely to assist member councils with energy efficiency projects. It must not be used for:
- Commercial purposes.
- Capturing images of individuals or private dwellings without the property owner’s consent.
- Surveillance or any illegal or unethical activities.
5. Technical Responsibility
- Basic user instructions, guidance, and tips are provided, but GAPTC offers no professional or technical advice. Councils are responsible for interpreting any results.
- GAPTC accepts no responsibility for the camera’s performance or compatibility with the borrower’s own devices or software.
- Borrowers should check minimum software requirements and ensure they have the necessary technology to use the camera.
6. Liability and Disclaimer
- The use of the camera is entirely at the borrower’s own risk . GAPTC cannot be held liable for any actions, decisions, financial costs, or outcomes resulting from the use of the camera or any interpretation of the images captured.
- GAPTC is not responsible for any indirect, consequential, or financial loss arising from use or failure of the equipment.
- Councils are advised to seek independent professional advice if they wish to act on findings from their survey.
7. Data and Privacy
- Councils must use the camera in compliance with data protection laws and respect privacy at all times. No personal data or identifiable images of individuals should be captured without appropriate consent.
- Any feedback or data shared with GAPTC will be anonymised or aggregated before being reported or published.
8. Feedback Requirement
- Borrowers agree to provide GAPTC with feedback at the end of the loan period to help monitor the scheme’s effectiveness.
9. Scheme Changes or Withdrawal
- GAPTC reserves the right to change these terms or withdraw the loan scheme at any time without notice.
10. Governing Law
- These terms and conditions are governed by the laws of England and Wales.
